前段时间,纽约一餐馆的员工工作时摔倒受伤,老板却以他们是黑工为由阻止员工报警就医,引发很大争议。

佐治亚州法律规定,所有企业经营者(含老板自己在内3个以上员工)必须为员工购买劳工保险, 无论员工为全职,兼职,或临时雇佣。不买劳工保险, 一旦被劳工局查获,将会有相应的罚款,严重时会被要求关店。

劳工保险都保什么

劳工保险保障员工因工作造成的职业伤害或疾病所带来的损失,常见的赔偿包括:医疗费用丶暂时性不能工作的收入赔偿丶永久性的残疾以及死亡的抚恤金。

如何计算劳工保险的保费

劳工保险的保费决定性因素主要有两方面

  • 员工的职位(员工的工作性质)
  • 员工的薪水

每次申请劳工保险时, 投保的期限是未来一年, 因为企业雇主必须先预估未来一年会发出去的总薪资, 保险公司则根据预估薪资,核算出预估的保费。 当保险一年期满后,保险公司会审计企业雇主此一年实际发出的薪水及其相应工作性质, 并核算出实际应收的保费, 在与当初预估的保费比较, 多退少补。

举例说明:

餐馆收银员换人, 启台员工数量增加减,这些情况都有可能发生。 当劳工保险一年期满后, 保险公司会要求雇主配合审计,重新核算保费, 多退少补。
